State Pre-emption:
Due to pre-emption by state law, Michigan cities and counties can only pass smokefree laws covering worksites, excluding restaurants and bars.
Smokefree Communities:
The following 23 counties and the Cities of Detroit, Grand Rapids, Marquette and Traverse City have enacted Smokefree Air laws: Baraga, Gogebic, Houghton, Calhoun, Ottawa, Berrien, St. Clair, Ingham, Washtenaw, Genesee, Chippewa, Emmet, Otsego, Antrim, Marquette, Midland, Saginaw, Charlevoix, Wayne, Alger, Mackinac, Schoolcraft and Lenawee.
Smokefree Population:
Based on the 2000 Census, these counties and cities have a total population of 4,724,969 or 47.5% of the total Michigan population of 9,938,444.
To put this in perspective, 24 states and the District of Columbia each have populations that are less than the 4,662,837 people now covered by Michigan's local Smokefree Air laws.
